By accessing or using useforce.ai (the "Site") or engaging Force Hiring Inc. ("Force") for executive search or Benchpark services, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site or our services.
Force provides AI-assisted executive search services and, to selected clients, access to Benchpark, a talent intelligence and succession planning platform. Services are delivered subject to a separate engagement agreement between Force and the client.
Submitting an enquiry via the Site does not constitute an engagement or create a contractual obligation on either party. An engagement commences only when a written mandate or service agreement has been signed by both parties.
You may use the Site for lawful purposes only. You agree not to:
All content on the Site — including text, graphics, logos, and methodology descriptions — is the property of Force Hiring Inc. or its licensors and is protected by applicable intellectual property law. You may not reproduce, distribute, or create derivative works from any Site content without our prior written permission.
Candidate market maps, shortlists, and assessments prepared by Force are the intellectual property of Force and are provided to clients under licence for the purposes of the specific engagement only.
Information shared with Force in the context of a search mandate — including organisational details, hiring criteria, and candidate assessments — is treated as confidential. Force will not disclose this information to third parties except as required to deliver the service or as required by law.
Clients agree to treat shortlisted candidate information as confidential and to use it only for the purposes of the relevant hiring process.
The Site and its content are provided 'as is'. Force makes no warranties, express or implied, regarding the accuracy or completeness of information on the Site.
To the maximum extent permitted by law, Force shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or reliance on its content. Our total liability in connection with any claim arising from these Terms shall not exceed the fees paid to Force in the 12 months preceding the claim, or €500, whichever is smaller.
Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence.
The Site may contain links to third-party websites. These links are provided for convenience only. Force has no control over the content or privacy practices of those sites and accepts no responsibility for them.
These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands, unless mandatory consumer protection law in your jurisdiction provides otherwise.
We may update these Terms from time to time. Continued use of the Site following any changes constitutes your acceptance of the revised Terms. The 'last updated' date at the top reflects the most recent version.
