1. Who we are
Force Hiring Inc. ("Force", "we", "us") is an AI-native executive search firm registered in New York City, USA. We can be contacted at hello@useforce.ai.
This Privacy Policy explains how we collect, use, store and protect personal data when you use our website (useforce.ai), submit an enquiry, or engage with us as a client or candidate.
2. Data we collect
We collect personal data in the following ways:
- Website enquiry forms — when you submit a Get Started or Benchpark Access form, we collect your name, work email, company name, role, and any details you choose to share about the search or your organisation.
- Candidate information — as part of a search mandate, we may process publicly available professional information about you (such as your LinkedIn profile, publications, or professional history) to assess your suitability for a role we are filling.
- Email correspondence — any personal data contained in emails or messages you send us.
- Website usage data — anonymised analytics data such as pages visited, browser type, and approximate location. We do not use cookies that require consent beyond those strictly necessary for the site to function.
3. How we use your data
We use personal data for the following purposes:
- To respond to your enquiry and provide executive search or Benchpark services.
- To assess candidate profiles against a search mandate, and to contact candidates about relevant opportunities.
- To improve our website and services through anonymised analytics.
- To comply with legal obligations.
We do not sell your personal data. We do not use it for automated decision-making that produces legal or similarly significant effects.
4. Lawful basis for processing
Under the General Data Protection Regulation (GDPR), we process your data on the following lawful bases:
- Contract — where processing is necessary to provide services you have requested.
- Legitimate interests — where we have a legitimate interest in processing candidate data to deliver a search mandate on behalf of a client. We balance this against the rights and interests of candidates.
- Consent — where you have explicitly consented to receive communications from us. You can withdraw consent at any time.
- Legal obligation — where processing is required by law.
5. How long we keep your data
We retain personal data only for as long as necessary for the purpose it was collected:
- Enquiry form data: up to 24 months from submission, or until the engagement concludes.
- Candidate data processed for a live search mandate: for the duration of the search plus 12 months.
- Candidate data held on a prospective basis: up to 24 months, with the right to request deletion at any time.
- Financial and contractual records: 7 years in accordance with Dutch law.
6. Who we share your data with
We share personal data only where necessary:
- Clients — we share candidate profiles and assessments with the client company that has engaged Force for a search mandate.
- Service providers — we use third-party tools to manage our operations (such as CRM and email platforms). These providers process data on our behalf under data processing agreements and are not permitted to use your data for their own purposes.
- Legal requirements — we may disclose data if required by law or to protect the rights and safety of Force, our clients, or others.
We do not transfer personal data outside the European Economic Area (EEA) without ensuring appropriate safeguards are in place.
7. Your rights
Under GDPR, you have the following rights regarding your personal data:
- Access — you can request a copy of the personal data we hold about you.
- Rectification — you can ask us to correct inaccurate or incomplete data.
- Erasure — you can ask us to delete your data where there is no legitimate reason for us to continue holding it.
- Restriction — you can ask us to limit how we use your data in certain circumstances.
- Portability — you can request your data in a machine-readable format.
- Objection — you can object to processing based on legitimate interests, including use for candidate outreach.
- Withdraw consent — where processing is based on consent, you can withdraw it at any time.
To exercise any of these rights, contact us at hello@useforce.ai. We will respond within 30 days. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) at autoriteitpersoonsgegevens.nl.
8. Security
We take appropriate technical and organisational measures to protect personal data against unauthorised access, loss, or destruction. Access to personal data is restricted to Force team members and operators who need it to perform their role.
9. Cookies
Our website uses only strictly necessary cookies required for basic functionality. We do not use tracking or advertising cookies. If we introduce analytics tools in future, we will update this policy and request consent where required.
10. Changes to this policy
We may update this Privacy Policy from time to time. The 'last updated' date at the top of this page will reflect any changes. Material changes will be communicated directly where we hold contact details for affected individuals.
For any questions about this policy or how we handle your data, contact us at hello@useforce.ai.
